GENIUS Act
Creates the first federal framework for payment stablecoins. Credit unions cannot issue directly — but may do so through a CUSO subsidiary. The NCUA is actively writing the licensing rules now.
Clarity Act
Establishes a market structure for digital commodities and allows financial institutions to offer custody and safekeeping services without treating digital assets as balance sheet deposits.

If members hold stablecoins instead of share accounts, credit unions lose the deposits that fund loans — disrupting the traditional intermediary relationship that credit unions depend on.
Services are unbundling.
Younger members no longer expect all financial products to live in one place. If your credit union doesn’t offer digital asset access, they’ll get it elsewhere — and their other products will follow.
Third-party partnerships are the near-term path.
Current NCUA guidance allows credit unions to partner with fintech providers for crypto buy/sell/hold services without direct custody. This is available now — no new legislation required.
Stablecoin issuance requires a CUSO subsidiary.
Under the GENIUS Act, direct issuance isn’t permitted for federally insured credit unions. A consortium CUSO model may be the most practical path for institutions under $1B in assets.
